Discuss, hear public comment and consider approval of Ordinance No. 21-01, authorizing the issuance and sale of industrial revenue bonds for the benefit of Buena Vista Energy Center, LLC (The "Company") to be entitled Otero County, New Mexico taxable industrial revenue bonds (Buena Vista Energy Center, LLC Project), Series 2021 (The "Bonds") in the maximum aggregate principal amount of $190,000,000 to provide funds to finance the acquisition, construction and equipping of solar photovoltaic electric generation and storage facilities for the purpose of generating and storing electricity. The ordinance provides for the payment of principal and interest on the bonds from lease payments to be paid by the company to the County and provides for the execution and delivery of an indenture, a lease agreement, a bond purchase agreement, the bonds, and other documents in connection with the issuance of the bonds and the project.
